Terms of service

1. Who you are contracting with

"SNN Systems", "the studio", "we" and "us" mean the software studio operated by Shahriar Nasim Nafi in Bangladesh. "You" means the person or organisation buying or using the software. These terms apply to this website, to the studio's apps (Calm Puzzles and Pencilwork), and to any software the studio sells directly in future. If you downloaded one of the apps from the App Store, Apple's standard licence agreement described in section 3 governs your use of it, and these terms apply only where they are consistent with that agreement.

By buying, downloading or using the software you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it.

2. What you are buying

You are buying a licence to use the software, not the software itself. The studio keeps ownership of the products, their source code and everything in them. Nothing you buy transfers copyright or any other intellectual property right to you.

The studio sells software in two ways:

• Apps from the App Store and Google Play, currently Calm Puzzles and Pencilwork. Each app is free to download, and Premium is bought inside the app through Apple or Google. Section 3 sets out how this works.
• Software bought directly from the studio, with Paddle handling the checkout. No product is sold this way at the moment. When one is, its licence terms, such as the number of seats or machines and how long updates are included, are shown at checkout and form part of these terms.

3. Apps from the App Store and Google Play

Which terms apply

• If you got the app from the App Store (iPhone or iPad), your use of it is governed by Apple's Licensed Application End User License Agreement. That licence is between you and the studio, not Apple. Apple is not responsible for the app, its content, maintenance or support, or for any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of that agreement and may enforce it against you.
• If you got the app from Google Play, these terms apply, together with the Google Play Terms of Service.

Free and Premium in Calm Puzzles

• Free: today's daily puzzle of every type, Easy puzzles of every type, hints, stats and every comfort setting.
• Premium: Medium, Hard and Expert puzzles of every type, and the archive of past daily puzzles.

Premium is sold as a yearly subscription or as a one-time lifetime purchase. The price and billing period are shown in the app before you buy, in your local currency. Payment is taken by Apple or Google, not by the studio and not by Paddle.

Subscriptions (Calm Puzzles only)

• The yearly subscription renews automatically each year until you cancel. On the App Store, cancel at least 24 hours before the end of the current period; your Apple Account is charged for the renewal within the 24 hours before it ends. On Google Play, cancel before the renewal date.
• You can turn off auto-renewal or cancel at any time in your App Store or Google Play subscription settings. Premium stays on until the end of the period you paid for.
• Eligible new subscribers may be offered a free trial, currently one month. When it is offered, the app shows the date and amount of the first charge. Cancel at least 24 hours before the trial ends and you are not charged.
• Deleting the app does not cancel a subscription.

Free and Premium in Pencilwork

Always free:

• Today's daily of every type, on a weekly ladder up to Expert.
• Unlimited Easy puzzles of every type.
• Every hint, pencil-mark mode, stat and theme, dark mode included.

Premium:

• Unlimited Medium, Hard and Expert in every type.
• The archive of past dailies.
• Every puzzle type added to Pencilwork later.

Premium in Pencilwork is sold only as a one-time lifetime purchase. There is no subscription and no free trial. The price is shown in the app before you buy, in your local currency. Payment is taken by Apple or Google, not by the studio and not by Paddle.

Lifetime purchase

The lifetime purchase is a single payment. It unlocks Premium for as long as the app is available, on devices that use the same App Store or Google Play account. Use Restore purchases in the app to unlock it on another device. Premium bought in one of the studio's apps does not unlock Premium in the other.

Refunds for app purchases

Refunds for purchases made in the app are handled by Apple or Google under their own rules. The refund policy explains how to ask.

4. Licence grant

Subject to these terms and, for anything paid, to payment, the studio grants you a non-exclusive, non-transferable, revocable licence to install and use the software on devices you own or control. Calm Puzzles and Pencilwork are licensed for personal use. Software bought directly from the studio may be used for personal or commercial purposes within the limits of the plan you bought. For an app downloaded from the App Store, the licence is the one in Apple's agreement described in section 3.

5. What you may not do

• Resell, sublicense, rent, lease or redistribute the software or a licence key.
• Share a licence key beyond the seats or machines it was sold for.
• Work around licensing, activation or payment controls, or use a key or purchase obtained by those means.
• Reverse engineer, decompile or disassemble the software, except to the extent that applicable law expressly permits it despite this restriction.
• Remove or alter copyright, licence or attribution notices.
• Use the software to break the law or to infringe someone else's rights.

6. Direct purchases: prices, payment and merchant of record

Paddle.com Market Ltd acts as the merchant of record for all software bought directly from SNN Systems. Paddle is the seller shown on your invoice and receipt, and the entry on your card or bank statement will read as Paddle rather than as SNN Systems. Paddle handles the payment, invoicing, sales tax and VAT on the studio's behalf, and your transaction is also subject to Paddle's own buyer terms and privacy notice.

Prices are shown in the currency and tax treatment applied at checkout. The studio may change prices for future purchases at any time; a change never affects a purchase already completed. Subscription renewals are charged at the price in effect when the period renews, and you will be told in advance if that price has gone up.

This section does not apply to purchases made in an app from the App Store or Google Play. Those are covered in section 3.

7. Refunds

Software bought directly from the studio through Paddle carries a 30-day money-back guarantee. Purchases made in an app from the App Store or Google Play are refunded under Apple's or Google's rules, and that guarantee does not apply to them. The details, and how to make a request in each case, are set out in the refund policy, which forms part of this agreement.

8. Updates and support

Support for Calm Puzzles and Pencilwork, and anything else to do with the studio, goes to contact@snnsystems.com. Response times are on the contact page. The studio may change, add or remove features over time. Where a change materially reduces what a paid product does, reasonable notice will be given.

9. Availability

Software is supplied as a release; the studio does not promise that any version is free of defects. Anything that depends on an outside service, such as buying or restoring Premium in Calm Puzzles or Pencilwork, can be interrupted by maintenance or by an outage at that service. Every puzzle in both apps works offline.

10. Warranties and disclaimer

The studio warrants that it has the right to license the software to you, and that the software will perform substantially as described on this site and on its store page at the time you buy.

Beyond that, and to the fullest extent permitted by law, the software and any online service it relies on are provided "as is" and "as available", without further warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. You are responsible for keeping your own backups of anything you store with the software.

11. Limitation of liability

To the fullest extent permitted by law, the studio is not liable for indirect, incidental, special or consequential loss, for loss of profit, revenue, goodwill or anticipated savings, or for loss or corruption of data, however caused.

Where the studio is liable, its total liability arising out of or in connection with these terms is limited to the amount you actually paid for the product in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are not affected by this section.

12. Termination

You may stop using the software at any time. The studio may end your licence if you materially breach these terms and do not put it right within 14 days of being asked to. When a licence ends you must stop using the software and remove it from your devices. Some sections carry on after termination: ownership, disclaimers, limitation of liability, and governing law.

13. Changes to these terms

These terms may be updated. The "last updated" date at the top of this page changes when they do, and the version published here at the time of your purchase is the one that governs it. Continuing to use the software after a change means you accept the updated terms.

14. Governing law and jurisdiction

These terms are governed by the laws of Bangladesh, and the courts of Dhaka have jurisdiction over any dispute arising from them.

If you are a consumer resident elsewhere, this does not deprive you of the protection of any mandatory consumer-protection rules of the country you live in, and you may still be able to bring proceedings in your local courts.

15. General

If any part of these terms is found unenforceable, the rest continues to apply. A failure to enforce a term is not a waiver of it. You may not transfer your rights under these terms without the studio's written consent; the studio may transfer them as part of a sale or reorganisation of the business, without reducing your rights. These terms, together with the refund policy and privacy policy, are the whole agreement between you and the studio.
